Secure Act 2 0 What the new legislation could mean for you

In response to the 1996 immigration laws, a diverse group of grassroots and national organizations launched the #Fix96 campaign. Since then, the efforts to fight back against immigrant criminalization and finally repeal the ‘96 laws has spread across the country. Now, the New Way Forward campaign seeks to repair the harm created by these unjust laws and pave a roadmap to creating an immigration system that does not rely on incarceration, detention or deportation. Look, you may think that the immigration laws are too harsh on criminal aliens . And you may even think that the criminal justice system in the United States itself is too harsh.

This isn’t the first time New York has contemplated following California’s lead on a cap-and-trade style program. Former Gov. Andrew Cuomo in 2015 discussed linking the regional emissions cap and trade program for power plants with California and Quebec’s carbon markets. New York was also engaged for years in discussions to create a regional cap-and-trade program for transportation emissions that ultimately collapsed amid rising concern about high gas prices and disagreement over emissions levels. This provision shows an almost complete lack of understanding as to how the Border Patrol does its job. Aliens are often apprehended in remote portions of the border, far away from Border Patrol stations — making it next to impossible for agents to drive hours to obtain a warrant of arrest. In addition, it is difficult to imagine how an agent could make a determination in the middle of the night whether any given alien would appear before an IJ.

If the impediments on ICE officers in the interior are burdensome, the ones on Border Patrol agents are downright bizarre and ill-informed. 5383 would place incredible impediments on both the authority of DHS officers to question aliens, and on those officers' authority to arrest. Not only would the bill add those restrictions to ICE's detention of aliens, it would also impose significant burdens on that agency and CBP to simply arrest aliens. It would make the amendments to the criminal grounds of removal and relief retroactive, so that even criminal aliens who have been removed from the United States, but who would not have been removable had that law been in effect, could apply to have their cases reopened or reconsidered. Immigration judges and the Board of Immigration Appeals would have no discretion not to reopen or reconsider those cases.
